AMA REACTS TO JANKLOW SENTENCE :x :x

PICKERINGTON, Ohio -- The American Motorcyclist Association (AMA)reports that former U.S. Rep. Bill Janklow (R-SD), who was convicted
December 8, 2003, of second-degree manslaughter and three other counts related to a traffic crash that claimed the life of a Minnesota motorcyclist, was sentenced today to 100 days in the Minnehaha County Jail. Janklow will not have to spend time in the South Dakota State
Penitentiary, and he could be eligible for a work-release program after 30 days in jail.

On Saturday, August 16, motorcyclist Randolph Scott of Hardwick,Minnesota, was killed in a collision with a car driven by Janklow. The
fatal crash took place at the intersection of two county roads in eastern South Dakota. Reports released by investigators indicated that
Janklow's car, traveling at speeds estimated at more that 70 mph, did not stop at the stop sign and continued into the path of the motorcycle,
giving the rider no chance to avoid the fatal collision.

Janklow's resignation from the U.S. House of Representatives took effect on January 20, 2004.

"The AMA is extremely disappointed with this sentence," said Edward Moreland, AMA Vice President for Government Relations. "This South
Dakota court has handed down a judicial insult to motorcyclists nationwide, and to the memory of Randolph Scott, the motorcyclist who paid the price for Mr. Janklow's criminal conduct."

According to a recent Associated Press review of South Dakota court records dating back to 1989, 80 percent of those convicted of second-degree manslaughter have been sent to jail or prison. Average jail time was six months, and the average prison term was almost seven years.

In the days following the accident, the AMA called on motorcyclists nationwide to contact South Dakota Gov. Mike Rounds and Attorney General
Larry Long, urging them to seek justice in the case.

The AMA notes that tragic crashes like the one involving Janklow, in which a car or other vehicle violates the right of way of a motorcycle,
are all too common on the nation's highways. The most comprehensive study ever conducted into motorcycle accidents found that nearly 75
percent of motorcycle accidents involve another vehicle, and that in almost two-thirds of those crashes, the cause could be traced to the
other vehicle violating the motorcyclist's right-of-way.

For more than a year, the AMA has been involved in a campaign called Motorcyclists Matter that focuses attention on the dangers faced by
motorcyclists and other vulnerable road users, including bicyclists and pedestrians, as a result of drivers who violate their right-of-way. The
Association is also campaigning in Washington, D.C., for funding for a new study into the causes of motorcycle accidents -- the first in more
than two decades.

And he will likely be in a protective custody cell so nice biker inmates can't get to him.

He will be in the county jail where there are no bad asses to worry him. Also did you know after his probation period runs out his felony conviction gets wiped off his record! Wonder how that works? With Bush being an old buddy there probably where some phone calls made. Just goes to show how the system realy works for the mighy and not the common people. If that was you or me they would have throwen the book at us.

:arrow: I think a little differently on this one than most of the posters so far. This guy, Janklow, was GOVERNOR of the state 4 times, U.S. SENATOR from that state, he was CONVICTED of a felony, given JAIL time (small as it is), forced OUT of CONGRESS, and everybody is complaining-which of these consequences has TED KENNEDY suffered because of his felonious driving? Which of these consequences did the state senator in TN suffer for killing that biker (other than having a highway named after him)? :shock: I was, frankly, surprised that Janklow didn't get off with acquittal or at most, a slap on the wrist. I think things are looking up. :shock:

Valker, I just happen to agree with you on this one.....

We had a van driver her in Iowa get off SCOTT free for killing 3 bikers when he crossed the center line. He went to sleep in a curve and took out 6 bikes, 3 dead, 2 seriously injured and 1 sustained a bunch of road rash......

Janklow, supposedly he can't drive for 3 years. That alone will kill him as he drove everyday when he was a Governor.

Don't go to Sturgis. A number of us have already start our campaign. I'm meeting the abate group on Sunday to start organizating the letter writing and notifying all the clubs, groups, gangs, and organizations. This seems the only way South Dakota will understand. We did contact the governors office earlier. The first trickle of emails seemed to go thru then they just started bouncing them back to the senders. That judgement pretty much says what the "motoring public" thinks about bikers.

I'm not mad at South Dakotans....just the judge. But like I said before, this is the most punishment ever dealt out to a politician who ran over and killed a biker. I'd bet money that the judge was quaking in his robes to even dish out that much.

I need some direction here. I think someone has a twisted wire in their BVD's or they are in a wrinkle.

Boycott, Sturgis, WHY.....

The people of SD did their job, they convicted Janklow.

The Judge is the one who let him off, so what good is it going to do to Boycott Sturgis over a Judge? Not one hairy little bit. I'll also bet you that when this Judge comes up for re-election he don't make it.

So, I'll just say this, Boycott all you want, I'll be there with bells on and having a heyday.

No they didn't.
Those same people elected Janklow governor 4 time, Attorney General once and then into the US Congress. His past driving record is well known, it's been published in the local and state papers. He didn't get the "wild Bill" nickname for nothing. Those same business owners in that little part of Southern SD supported him and in all of his campaigns in all of the elections he ran in. The same people elected the judge the handed out the sentence.
Of course they're responsible.

Governor Rounds,

I would like to start out by saying that I was in your beautiful State last year. Myself and two friends took a three week/7,000+ mile motorcycle trip from the East coast and made a big loop of this great country ... your South Dakota was included.

Since my return home the end of August I have been watching and reading about the Janklow case. I was shocked to learn that he is a self confessed "speeder"/"reckless" driver and yet he still has a drivers license. I ask you WHY ... because he is a government official? Do government officials have different standards then "we the people"? If I had a driving record like Mr. Jaklow (term "Mr." used very loosely here - I have no respect for that man) my drivers license would have been suspended if not revoked!

I was pleased to see Janklow resign his position. I was happy to see him convicted in December ... but why second degree manslaughter? Why not a more severe charge? He certainly is educated well enough that he would have known that speeding and running stop signs could result in the death or serious injury to another human being. Now down to the meat of this note - the sentencing! One hundred days in a COUNTY jail, work release after 30 days! Every single resident of South Dakota should be embarrassed and ashamed. You as Governor should DEMAND your State Attorney General take action against the judge that handed down this ruling. You as Governor should DEMAND your AG and Legislative Branch to amend the laws so that a travesty like this will never happen again!

It is true, I may not know Mr. Scott or his family personally BUT he was my "brother in the wind". What value did your court system place on Mr. Scott's life? What value do you place on my life or my families lives? You don't need to answer those questions ... the answer is too obvious now. The question I do want an answer to is - "What are you going to do about this?". Will you right a wrong or will you turn your head for your colleague? Please, I ask you to stand up, take notice and do the right thing.
